Terms of Service

Quesmedia is a registered trading name of Nick Thornley, number 018179B. All first person pronouns in this document should be taken to mean "Nick Thornley trading as Quesmedia"

Quesmedia Sites (also referred to as the "Service") is the name of a hosted website platform provided by Quesmedia. You may use the Service to create or publish your own sites, products or services ("Your Sites").

Acceptable Use Policy

Simply put, you are entirely responsible for what you publish, and any harm resulting from it or your conduct.

You must

  • Be over 16 years of age.
  • Comply with our Acceptable Use Policy and represent and warrant that all your User Content complies with our Content Standards.
  • Make every effort to keep your account safe and secure.
  • Make sure you have all the appropriate rights and consent for the material you publish.
  • Take responsibility for any other websites or resources you link to.

You must not

  • Use Quesmedia Sites in any unlawful manner, or for any unlawful purpose.
  • Attempt to compromise the Service or any of its users by acting maliciously, for example, by attempting to insert malicious code, viruses or harmful data into the system, or by attempting to overburden the system, as determined by us.
  • Disclose sensitive personal information of others.

Account Security

To use the Service with the privilege of an authenticated user, you must have an account ("Account"). You must make sure your account information is accurate. Your Account will be created by us or another privileged Account.

A new Account will require a password to be set by the Account holder in a process that verifies the Account holder's identity via their email address.

Keep your Account safe. You are solely responsible for any activity on your Account and for maintaining the confidentiality and security of your password.

You must inform us immediately on suspicion that your account has been compromised. If you think your password has been compromised or your account has been accessed by someone other than yourself, you should change your password and inform us immediately.

If you are a user on the system who has the ability to create or modify other user accounts it is your responsibility to verify the identity of those users and to make sure those users agree to and follow these terms. If a user account you control requires a new password you may trigger the password reset process for them but you must not update their password yourself.

Your Content

Your content stays yours. Users of Quesmedia Sites may add/upload content, including without limitation text, photos, images, audio, video and any other materials ("User Content"). Your User Content remains yours, except for the limited rights that enable us to provide, improve, promote and protect the Service as described in this agreement.

Content Standards

These Content Standards apply to any and all material which you contribute ("Contribution") to our Service. We will determine, at our discretion, whether a Contribution breaches the Content Standards. Content Standards should be complied with in the spirit in which they are written.

You Contribution must

  • Be accurate (where it states facts).
  • Be genuinely held (where it states opinion).
  • Comply with the law applicable in the Isle of Man, United Kingdom and any country from which it is posted.

You Contribution must-not

  • Be defamatory of any person.
  • Be obscene, offensive, hateful or inflammatory.
  • Promote sexually explicit material.
  • Promote violence.
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any copyright, database right or trademark of any other person.
  • Be likely to deceive any person.
  • Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • Promote any illegal activity.
  • Be in contempt of court.
  • Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.
  • Be likely to harass, upset, embarrass, alarm or annoy any other person.
  • Impersonate any person, or misrepresent your identity or affiliation with any person.
  • Give the impression that the Contribution emanates from a source that it does not.
  • Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
  • Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.

Privacy

Our Quesmedia Sites Privacy Policy Addendum explains how we collect, use and share your and visitors and users of Your Sites ("End Users") information.

Your Responsibilities

It is your responsibility to ensure Your Sites and your End Users comply with all relevant laws and regulations related to Your Sites and your End Users, including without limitation the posting of your own privacy policy.

Updates to these Terms of Service

We may modify these Terms of Service from time to time, and will publish the most current version on our site. To help you we include the last updated/effective date at the start of the document. If a modification meaningfully reduces your rights, we'll notify you (by, for example, sending you an email or displaying a prominent notice within the Service).
